Statement from President Mark Dimondstein to APWU on Status of Collective Bargaining

12/21/2018 – The Collective Bargaining Agreement (Union Contract) between the American Postal Workers Union and the United States Postal Service initially expired on September 20, 2018. Negotiations began in July with a big kick off and national day of action during which many of you participated as together we are “Fighting Today for a Better Tomorrow!” Since our contract expired there have been four extensions of negotiations in an effort to reach a voluntary agreement.

As your president, taking general guidance from the National Negotiating Committee, I led in reaching a tentative agreement with management on December 6, 2018. I believe it to be fair and positive for the members.

I have been advised by In-Plant-Support that all previously unassigned regular clerks have been assigned to a duty assignment, and that there are 16 residual vacancies. Accordingly, the Oakland Local APWU will be working diligently to get PSEs converted to career status as soon as possible, and to have the conversions effectuated in compliance with the Collective Bargaining Agreement (CBA) with an accurate PSE seniority list.

Further Update / George H.R Bush National Day of Observation

The Senior Plant Manager has advised me that administrative leave will be provided for Plant employees for the National Day Of Observance (NDOO) after the peak season (January 4, 2019). Number 10 of the NDOO MOU states that a day of administrative leave must be granted and used within six months of the NDOO (December 5, 2018) or by the end of the Fiscal Year (September 30, 2019), whichever is later. Employees will select the day that they want to use their administrative leave, subject to management’s approval.

The City of Oakland has advised me that all retail offices will be closed on the NDOO. Employees with the NDOO as a nonscheduled workday will be granted a day of administrative leave at a future date.

PSEs are not eligible for the NDOO administrative leave. They get paid for all hours worked on the NDOO.

(See announcement and MOU below) I have also been advised by APWU Headquarters that PSEs will not be granted administrative leave for the Bush National Day of Observance.

The PMG  just announced that the USPS will participate in the day of mourning per 519.4 of the ELM
Management just released the following statement : President Donald J. Trump has proclaimed Dec. 5 as a national day of mourning throughout the United States and has called on the American people to pay homage to memory of former President George H.W. Bush on that day.
Out of respect for President Bush, the nation’s 41st commander in chief, and to honor his vast contributions to the United States during his lifetime, and consistent with the presidential proclamation, the Postal Service will observe the national day of mourning.
The Postal Service will suspend regular mail delivery and retail service Dec. 5. USPS will provide limited package delivery service on that day to ensure that the Postal Service network remains fluid and USPS does not experience any impacts to its package delivery operations that might negatively affect customers or business partners during the remainder of the busy holiday season.
All Postal Service facilities — including headquarters in Washington, DC, and area and district administrative offices — are included in the national day of mourning. Local managers will advise employees on staffing levels to maintain operations and prepare for the resumption of regular activities Thursday, Dec. 6.
Pay and leave administration for the national day of observance for affected bargaining unit employees is governed by section 519.4 of the ELM 519.4 provisions of May 4, 2000, memorandums of agreement between the Postal Service and the APWU

Brothers and Sisters,
Please find attached the notification from the USPS that they have revised the leave that is offered through the Wounded Warriors Leave (WWL) Act of 2015 to all eligible employees at the beginning of each leave year. This will begin effective leave year 2019 (January 5, 2019).  The eligible employees will receive an allotment of 104 hours of WWL. WWL will continue to be provided to newly hired employees at the beginning of their term of employment as required by the terms of the 2015 Act. 
WWL is an authorized absence from work to undergo medical treatment for a service-connected disability rated 30% or more. It is a separate leave category, distinct from sick leave.  Approved WWL cannot be adversely used against an eligible employee for attendance and discipline purposes. To request WWL an employee must submit a PS Form 3971 to their appropriate supervisor.  There is an exception to the advance approval for unexpected treatment the qualifies for WWL. The supervisor is responsible for approving or disapproving the PS Form 3971.
To verify that WWL requested is appropriately used for the treatment of the service-connected disability, the requesting employee must submit to the supervisor a copy of PS Form 5980,  Treatment Verification for WWL, certified by a health care provider that the employee used the leave to receive treatment for the covered disability.  The employee must provide the verification no later than 15 calendar days after the employee returns to work.  A properly completed PS Form 5980 also provides for frequency and/or duration of prescribed treatment that would necessitate the employee taking WWL beyond the date of appointment identified in the Employee Information portion of the form.
  • Eligible new hires will receive 104 hours of WWL upon hire (as required by the 2015 law) to be used for the remainder of the current calendar.
  • Each January, all disabled veterans with a 30% or more disability rating will receive 104 hours of WWL to use during the calendar year.
  • At the end of each calendar year, an remaining WWL will be forfeited but, assuming the employee still has a combined disability rating of 30% or more, he/she will receive a new 104 hours at the start of the new year.
  • Any unused WWL is not rolled over to the next year, nor will it be paid out if the employee leaves.
  • WWL can be used concurrent with FMLA, when appropriate.
