NTFT Duty Assignments and Required Overtime

The CBA Memorandum regarding Non-Traditional Full-Time (NTFT) Duty Assignments, Overtime Rule 1, prohibits management from requiring full-time career clerk and motor vehicle craft employees who are not on the Overtime Desired List (ODL) and are in an installation with employees working NTFT duty assignments in the same Functional area, to work overtime except in an emergency. Accordingly,  all clerk and motor vehicle craft employees who are assigned to the Oakland P&DC (a Function 1 Mail Processing area), regardless of tour or section, should not be required to work overtime except in an emergency. In the motor vehicle craft, employees may also be required to work overtime in the event of unforeseeable circumstances (e.g., PVS drivers stuck in traffic, weather conditions).

An emergency is defined as “an unforeseen circumstance or a combination of circumstances which calls for immediate action in a situation which is not expected to be of a recurring nature.” (Article 3, Emergency Situations, CBA)

If you are a non – ODL  Oakland P&DC clerk or motor vehicle craft employee, and have been required to work overtime and an emergency situation did not exist, you should contact you steward.

Arbitration on Subcontracting of MailBox Work has Concluded.

It took over 4000 documents and 3 days of hearing for the parties to present their cases. After the parties have presented their post hearing brief to the arbitrator, a decision should be issued in approximately 60 days.

California PVS – HCR Conversion Update

Dear MVS Members:

The arbitration hearings regarding the Postal Service’s attempt to eliminate the Postal Vehicle Service (PVS) in California concluded on Thursday, January 17, 2013. There were seven days of hearings.

In mid February 2013 the parties will submit their briefs (closing arguments) to the arbitrator and the arbitrator should issue an award in March 2013.

According to union sources, the APWU’s team of officers, lawyers, economist, contract experts, statisticians and craft witnesses did a remarkable job in presenting the union’s case.

If there are any new developments before the arbitrator issue his award, you will be advised.

Excessing Event 39951

The Oakland Local was notified on August 1, 2012, that pursuant to Article 12.5.C of the National Agreement, forty (40) level 6 Oakland bid cluster clerks were going to be involuntarily reassigned from the clerk craft and/or the Oakland installation relative to a staffing & scheduling review based on BPI efficiency improvements (Excessing Event 39951).

Yesterday I requested Senior Plant Manager Balwant Grewal to cancel Excessing Event 39951 via the VERA and other reductions of clerks in the Oakland bid cluster since August 1, 2012.

The Senior Plant Manager responded today by informing me that as soon as all the VERA is finalized she would get back with me. APWU Western Regional Coordinator Omar Gonzalez also contacted me today and informed me that most excessing events were going to be modified significantly according to the Postal Service Area office and that he would notify me when the modifications were made.

Ryder Truck Safety Issues

Attention Motor Vehicle Craft Members:

Western Regional Coordinator Omar Gonzalez and National Business Agent Javier Pineres have met with the Postal Service’s Area Safety management twice regarding the Ryder truck safety issues.

I received an email from Omar on December 21,2012, indicating that it was amazing that of all the issues and concerns from all the members in all the Districts, only one (1) 1767 from Oakland made it to the 3rd level of the process. If you have filed a 1767, Omar needs it ASAP!

During the second meeting with Area Safety, management stated that where the Ryder trucks are too big for the stations, local management should work with District Transportation to swap the Ryder trucks for the retrofitted Postal 7 & 11 tons. Also, Local supervisor / manager should work together with drivers to identify the problem stations / stops.

Drivers, please provide your steward with the name and location of any station where the size of the Ryder trucks pose a safety concern. Where there’s a concern, with either the length or the height, please describe the problem / issue. It is very difficult, if not impossible, for our regional representatives to identify the problem spots without our help at the local level. If management fails to cooperate with you, please contact your steward so that we can advise our regional representatives.
